The Truth About the Supreme Court’s Ruling on Opting-out of LGBTQ Curriculum

In June 2025, the Supreme Court made a 6-3 decision in favor of parents seeking to opt their children out of public school instruction that conflicts with sincerely held religious beliefs. (see: link and link).
Many people are celebrating this decision, hailing it as a victory for the religious freedom of parents. But we view it differently: it's a small victory but will still take years to be resolved (if ever) and it is very unlikely to have the real world impact that some are describing.

The Supreme Court's decision does not apply everywhere, such as (importantly) in your school district.
Unless you live in Montgomery County in Maryland, this ruling does not apply to you. If your school district has a similar program, yes, you may be able to sue your school district on similar grounds, and will probably achieve a similar victory after spending months or years in court to do so. But if the conditions in your school district do not match the same as in the case, litigating it in the same way could easily have a different result depending upon the facts and circumstances in your specific school district. If your school district has an opt-out system of a different nature, your case will be different.
Legally this is only a small victory
The ruling was only an injunction issued while the actual lawsuit is adjucated. So while the lawsuit is being decided by the district court, the parents will have a reprieve. The result of the lawsuit, after months or years, will then have one of either of these outcomes:
The lawsuit will fail and the parents will not be able to appeal because their legal counsel did not make the right arguments or the judge in the case will remove the legal force behind their arguments, preventing a successful appeal.
The lawsuit will succeed, but the scope of the ruling will only apply to the parties in question or the school district in Maryland.
The lawsuit will fail and the parents will appeal, which will takes years and perhaps millions of dollars to get to Supreme Court, which will then:
Not make a ruling, leaving the case in a state of limbo.
Make a ruling, but the scope will be too narrow to apply elsewhere.
Make a ruling that guarantees and affirms the 1st amendment right.
Only in 3c above will parents across all sates gain an affirmation of the freedoms they have.
Note: number two is not a bad result, but it doesn't necessarily create a precedent.
The Supreme Court's decision will likely not change how children are exposed to indoctrination: public schools will sneak it in
First and foremost, how exactly is this ruling to be enforced? There are no cameras in classrooms. Unless there's some kind of 3rd party watchdog hired to review and approve all schoolroom materials, its not clear how the order can be enforced successfully.
While its likely that gross violations of the SCOTUS order will be discovered, what if a teacher puts posters on the wall that are LGBTQ themed? What if they don't create those posters, but instead put up the creations of their favorite LGBTQ identifying students? What if they circulate a worksheet that references the students to research LGTBQ materials? Perhaps they provide voluntarily extra credit work for anyone that needs an LGTBQ story, which is not overtly described as such. What if they wear a badge indicating they support LGTBQ causes or discuss such materials in an after school club? Or use language that emphasizes their beliefs? (see below)


In other words, there are too many loopholes for teachers to avoid the ruling. And remember that nearly all states have mandated curriculum that applies across all school districts, where the content of the curriculum is selected by the very same people that believe that parents do not have a right to their religious freedoms. There are a thousand ways in which teachers and administrators can work around this ruling.

The opposition is determined to fight for every detail
As an example, in Feb. 2025 Trump signed an executive order banning transgender athletes
from women's sports, which was a direct application of Title 9's non-discrimination clause. Title 9 was intended to allow equal opportunities for females. And yet, schools and states have continued to allow men to compete in women's sports throughout the year, effectively discriminating against natural women who simply do not have the same musculature or skeletal structure as men (even after using cross-sex hormones). The law did nothing to stop it. Young girls were forced into the political arena in sometimes very public ways; getting injured, forfeiting or simply attempting to unsuccessfully defeat their male competitors. How do you think this supreme court will stop the LGBT indoctrination of students?
What if you are able to successfully opt-out your child?
You have to consider what will happen if a student does opt-out: would the school then be discrete and impartial in the treatment of your child, in the classroom each and everyday? Or will the child be singled out and penalized for not participating in the day's lesson, by the teacher (...the same teaacher that believes in the LGTBQ curriculum and who has now identified your child as an "enemy" or from a "bigot family"? Lets be real: the majority of teachers are teaching LGBTQ curriculum because they believe that they are morally right, and you are morally wrong. LGBTQ is just as much a religion as Christianity, and the truth of the matter is, that its adherents believe in gender ideaology and will fight for it, just as you do.
The problem is this: their battleground is one where you are not allowed to be present (in the school classroom) and where they have unlimited power.
Here is the reality:
The celebrations about this ruling are disproportionate to the serious public school issues our communities face due to the broken school system. Problems in schools will continue despite this "win" from the Supreme Court this week and those problems cannot be ignored.
